2.44.010 Purpose
The purpose of this chapter is to establish a county policy regarding county employees charged or convicted of driving vehicles while under the influence of any intoxicating liquor or controlled substance. (Ord. 273 §1(part), 1977)

2.44.020 Definitions
As used in this chapter: 
    A.  "County employee" means any person who is by law deemed in any manner to be an employee of the county, excepting any elected county officer. 
    B.  "County vehicle" means any vehicle, as defined in NRS and any subsequent amendments thereto, which is owned, leased or otherwise in the custody or control of the county. 
    C.  "Guilty" means any judgment of guilt by a court or jury, including any plea of guilty or nolo contendere. (Ord. 273 §1(part), 1977)

2.44.030 Policy
    A.  Any employee of the county who is adjudicated guilty by a court of competent jurisdiction of any offense which includes the driving of a county vehicle at any time while under the influence of any intoxicating liquor or any controlled substance, as defined in NRS, including any subsequent amendments thereto, or who is found guilty of driving any other vehicle while operating said vehicle within the scope of his or her county employment, shall be terminated from county employment immediately upon such adjudication of guilt. The termination shall not be stayed by the filing of an appeal by the employee; however, in the event any such appeal results in the setting aside of the employee's conviction, the county may consider reemployment of the person. 
    B. 
        1.  Any employee of the county who is formally charged with any offense which includes the driving of a county vehicle at any time while under the influence of any intoxicating liquor or any controlled substance, as defined in NRS, including any subsequent amendments thereto, or who is formally charged with driving any other vehicle while operating the vehicle within the scope of his or her county employment, may be suspended by his or her department supervisor pending the disposition of the charge against the employee. The terms of any suspension shall be within the discretion of the department supervisor. 
        2.  If the employee is subsequently adjudicated guilty within the meaning of this chapter, the employee shall be terminated immediately. If the employee is not found guilty of any offense including the elements specified above, then said employee shall be reinstated with full benefits, including any such benefits withheld during the suspension period.
