2.50.010 Law library trustees--Members--Appointments--Terms

    A.  Pursuant to the provisions of NRS 380.010 (Law Libraries), there is established a board of law library trustees consisting of five members. The district court judges of the Ninth Judicial District in and for Douglas County, State of Nevada, are appointed as ex-officio trustees for the law library and the board of county commissioners shall appoint three additional trustees to complete the board, including at least one member of the Nevada State Bar admitted to practice before the Ninth Judicial District Bar, at least two members who are not attorneys at law, and at least one member of the board of county commissioners.
    B.  Appointed members of the board must be appointed by the board of county commissioners at the first meeting of the board in January of each year, to serve for terms of two years, with half of the terms expiring each year.   (Ord. 1435, 2015; Ord. 401 §1(part), 1982)

2.50.020 Removal of trustee--Vacancies
The board of law library trustees, by majority vote of all members recorded in the minutes with ayes and noes at length, may: 
    A.  Remove any trustee who neglects to attend the meetings of the board or who absents himself from such meetings; such removal to be approved by the board of county commissioners; 
    B.  Fill all vacancies that occur in the board from time to time for whatever reason. The board of law library trustees must at all times include at least two persons who are not attorneys at law but are members of the board of county commissioners, subject to approval by the board of county commissioners. 2.50.030 Officers and assistants--Elections--Duties--Salaries
    A.  The members of the board of law library trustees shall appoint one of their number as president. 
    B.  They shall elect a secretary who shall: 
        1.  Keep a full statement and account of all property, money, receipts and expenditures of the board;      
        2. Keep a record and full minutes in writing and an audio recording or transcript of all proceedings of the board. The secretary may certify to such proceedings, or any part or portion thereof, under his hand, verified by the board in a manner adopted by the board.   
    C.  The board of law library trustees, by a majority vote of all the members recorded in the minutes with ayes and noes at length, shall have the power:    
        1.  To define the powers and describe the duties of any and all officers, determine number, and elect all necessary subordinate officers and assistants; 
        2.  To remove, at its pleasure, any officer or assistant as provided in this chapter.

2.50.040 Meetings of the board--Quorum
    A.  The board of law library trustees shall meet at least once each calendar quarter and at such other time as the board may appoint, at a place to be appointed for that purpose by the board. 
    B.  A majority of all the members shall constitute a quorum for business. 
    C.  On or before the first Monday in December of each year, the board of law library trustees shall make an annual report to the board of county commissioners giving: 
        1.  The condition of the board's trust; 
        2.  A full statement of the board's property and money received, whence derived, how used and how expended; 
        3.  The number of books, periodicals and other publications contained within the law library 
        4.  The number of books, periodicals and other publications added by purchase, gift or otherwise during the year; 
        5.  The number of books, periodicals and other publications lost or missing; 
        6.  Such other interest as may be required by the board of county commissioners or as might be of interest.
    D.  At the same time, a financial report showing all receipts and disbursements of money shall also be made by the secretary. The report shall be duly verified by the oath of the secretary.

2.50.050 Powers of the board
 The board of law library trustees, by a majority vote of all of its members, to be recorded in the minutes with ayes and noes at length, with the approval of the board of county commissioners, shall have the power: 
    A.  To make and enforce all rules, regulations and bylaws necessary for the administration, government and protection of the library and all property belonging thereto, or which may be loaned, devised, bequeathed or donated to the same; 
    B.  To purchase books, journals, publications and other personal property; 
    C.  To contract with any existing law library association to make use of its library for the purpose of a public law library, under proper rules and regulations to be prescribed by the board, either by lease or such other contract as may best carry the purposes of this chapter into effect; 
    D.  To do all that may be necessary to carry into effect the provisions of this chapter. (Ord. 401 §1(part), 1982)

2.50.060 Law library fund--Creation--Use--Source
    A.  Pursuant to this chapter, and the provisions of NRS 380.110, the board of county commissioners shall require that from the fees received by the county clerk pursuant to NRS 19.013, a sum not to exceed twenty dollars, which sum shall be established by resolution of the board of county commissioners, shall be paid to a fund designated as the law library fund. These allocations shall be made from the fees collected by the county clerk for the commencement in or removal to the district court of the county, of any civil action, proceeding or appeal, on filing the first paper therein, or from the fees collected by the county clerk for the appearance of any defendant, or any number of defendants answering jointly or separately, or from both of such sources as may be determined by the board of county commissioners. 
    B.  All money so set aside must be paid by the county clerk to the county-treasurer, who shall keep it separate in the law library fund. 
    C.  The board of county commissioners may transfer from the county general fund to the law library fund such amounts as it determines are necessary for the purposes of the law library. 
    D.  Money in the law library fund must be: 
        1.  Expended for the purchase of law books, journals, periodicals and other publications; 
        2.  Expended for the establishment and maintenance of the law library; 
        3.  Drawn therefrom and used and applied only as provided in this chapter.

2.50.070 Payment from law library fund
    A.  The board of law library trustees, by majority vote of all its members, to be recorded in the minutes with ayes and noes at length, shall have the power, upon approval by the board of county commissioners, to order the drawing and payment, upon properly authenticated vouchers duly verified and certified by the president and the secretary, of money from the law library fund, for any liability or expenditure authorized by law. 
    B.  The orders and demands of the trustees, when duly made and authenticated as provided in subsection A of this section, shall be verified and audited by the county auditor and paid by the county treasurer from the law library fund, full entries and records being kept thereof as in any other case. 2.50.080 Library room to be furnished by county commissioners
The board of county commissioners shall provide a library room in the Judicial and Law Enforcement Building for the use of a law library established under the provisions of this chapter. (Ord. 401 §1(part), 1982)

2.50.090 Accessibility of law library to general public
The law library must be free to all inhabitants of the county. The board of law library trustees may prescribe regulations and impose restrictions on the privilege of borrowing books and materials from the law library, but may not restrict the accessibility of the library to the general public during normal business hours.
