18.10.010 Creation and organization

Pursuant to NRS 474.460 et seq., and based upon the finding by the board of county commissioners of Douglas County, it is necessary to provide for the prevention and extinguishment of fires and, pursuant to NRS 474.180, to provide for emergency medical services within Douglas County not included in any other fire district, a fire protection district, the boundaries of which are described in section 18.10.020, is formed and shall be named the East Fork Fire Protection District. Effective January 4, 2017, pursuant to NRS 474.535, the East Fork Fire Protection District shall be governed as a district created by election under NRS 474.010 to 474.450.  (Ord. 1466, 2016; Ord. 1428, 2014; Ord. 371 §2(part), 1981)

18.10.020 Boundaries
The boundaries of the East Fork Fire Protection District are described as follows: 
    A.  All that portion of Douglas County, Nevada, as defined in N.R.S. 243.045, excluding: All that land within the Tahoe-Douglas Fire Protection District as recorded June 5, 1980, in Book 680 at page 662, Douglas County, Nevada; 
    B.  The boundaries of the East Fork Fire Protection District are further described by Exhibit "A," the third amended map of the East Fork Fire Protection District, which is attached and incorporated by reference. (Ord. 1248, 2008; Ord. 498, 1989; Ord. 371 §2(part), 1981; Ord. 1248, 2008)

18.10.030 Organization
    A. The board of county commissioners shall be the ex-officio board of fire commissioners which shall govern the East Fork Fire Protection District until January 4, 2017.
B. The chairman of the board of county commissioners shall be ex-officio chairman of the board of fire commissioners for the East Fork Fire Protection District until January 4, 2017.
C. The county clerk shall function as the ex-officio clerk of the East Fork Fire Protection District until January 4, 2017.
D. The county treasurer shall be the ex-officio treasurer for the East Fork Fire Protection District until January 4, 2017.
E. The district attorney of Douglas County shall be the ex-officio attorney for the East Fork Fire Protection District until January 4, 2017.
F.  Effective January 4, 2017, the East Fork Fire Protection District shall be governed by a Board of Directors subject to NRS 474.130 to NRS 474.180.  The District shall be divided into five (5) election precincts which coincide with the Douglas County Commissioner precincts, excluding any land in any precinct within the Tahoe Douglas Fire Protection District as described in the document recorded June 5, 1980 at page 662, Douglas County, Nevada.  The precincts shall be numbered consecutively.  Qualified director candidates must be a resident of the election precinct for which the director is elected, and shall be elected at large by the district.
G.  On or before December 31, 2016, the Douglas County Board of Commissioners shall appoint the initial directors of the East Fork Fire Protection District Board of Directors for each election precinct pursuant to NRS 474.535(6)(b) to terms established in the manner provided in NRS 474.130.  Each appointed director must be a resident of the election precinct for which the director is appointed, and shall serve until a qualified successor is elected.  Each appointed director shall begin service on January 4, 2017.  (Ord. 1466, 2016; Ord. 371 §2(part), 1981)

18.10.040 Assumption of All Debts, Obligations, and Liabilities of Former District
    A. Upon the completion of the reorganization of the East Fork Fire Protection District as a district created by election on January 4, 2017, the district shall assume all debts, obligations, liabilities, and assets of the former district.  (Ord. 1466, 2016; Ord. 371 §2(part), 1981)

18.10.050 Dissolution of Sierra Forest Fire Protection District and its reorganization as the East Fork Fire Protection District
    A.  Effective May 15, 2008, the Clark-McNary Fire Protection District (the Sierra Forest Fire Protection District) as created by the board of Douglas County commissioners, October 5, 1950, in Commissioner’s Book 3 at Page 179, Douglas County, Nevada, as amended by description and map recorded December 5, 1988, in Book 1288 pages 437-441, and including those lands excluded therefrom being shown in county commissioner’s minutes dated January 20, 1976, in Commissioner’s Book 6 at Page 410, Douglas County, Nevada, and shown in commissioner’s minutes dated November 4, 1976, in Commissioner’s Book 6 at Page 518, is dissolved. 
    B.  Effective May 15, 2008, the area until now known as the Sierra Forest Fire Protection District, described immediately above, is reorganized pursuant to NRS 474.555 as part of the East Fork Fire Protection District, the boundaries of which are described in section 18.10.020 above.
