3.34.010 Authority
Section 3.500 of the Nevada Revised Statutes permits the establishment of a program of dispute resolution for District Court cases which involve the custody or visitation of a child in counties whose population is 100,000 or less.  Section 244.1604 of the Nevada Revised Statutes permits the establishment of a Neighborhood Justice Center in Justice Court cases in counties whose population is 100,000 or less.  (Ord. 1448, 2015; Ord. 735, 1996)

3.34.020 Creation of fund
A. An account for dispute resolution for District Court cases that involve the custody or visitation of a child is created in the County general fund.  The balance of the account created for dispute resolution through Ordinance 96-735 in District Court shall be transferred into this new account.  Upon transfer to the new account, the account created for dispute resolution through Ordinance 96-735 in District Court shall be closed.
 B. An account for dispute resolution through a Neighborhood Justice Center for Justice Court cases is created in the County general fund.
 C. The balance of the account created for dispute resolution through Ordinance 96-735 in Justice Court may be transferred into either the account created for dispute resolution in District Court in subsection A or the account created for dispute resolution in Justice Court in subsection B at the discretion of the Judicial Service Department.  Upon transfer to the new account, the account created for dispute resolution through Ordinance 96-735 in Justice Court shall be closed.  (Ord. 1448, 2015; Ord. 735, 1996)

3.34.030 Justice Court filing fees
Pursuant to Section 4.063(3) of the Nevada Revised Statutes, in addition to any other fee required by law, a fee of $10 shall be paid on the commencement of any action or proceeding in Justice Court for which a fee is required and on the filing of any answer or appearance in any action or proceeding for which a fee is required.  (Ord. 1448, 2015)

3.34.040 District Court filing fees
Pursuant to Section 19.0313 of the Nevada Revised Statutes, in addition to any other fee required by law, a fee of $10 shall be paid on the commencement of any action or proceeding in District Court for which a fee is required and on the filing of any answer or appearance in any action or proceeding for which a fee is required.  (Ord. 1448, 2015)

3.34.050 Transmittal of collected fees
On or before the fifth day of each month, the fees collected during the preceding month shall be accounted for and paid over to the County Treasurer for credit to the accounts created pursuant to section 3.34.020 of this code.  (Ord. 1448, 2015)

3.34.060 Use of fees
A. The money in the account for dispute resolution through a Neighborhood Justice Center for Justice Court cases must be used only to support a neighborhood justice center established pursuant to NRS 244.1607.
B. The money in the account for dispute resolution for District Court cases that involve the custody of visitation of a child created pursuant to Section 3.34.020 of this code must not be used for purposes other than programs established pursuant to Section 3.500 of the Nevada Revised Statutes and Section 3.34.010 of this code.  (Ord. 1448, 2015)

3.34.070 Fees, gifts and grants
A. The account for dispute resolution for District Court cases that involve the custody or visitation of a child may accept gifts and grants offered in support of the program as provided in paragraph f of subsection 2 in Section 3.500 of the Nevada Revised Statutes.
B. The Neighborhood Justice Center may charge fees for services which are provided relating to the resolution of complex cases and training provided by the center.
 C. The Neighborhood Justice Center may accept gifts and grants offered in support of the program.  Such gifts and grants shall be deposited in the fund created pursuant to Section 3.34.050.  (Ord. 1448, 2015; Ord. 735, 1996)

3.34.080 Neighborhood Justice Center services
The Neighborhood Justice Center must provide, at no charge:
A. A forum for the impartial mediation of minor disputes including, but not limited to, disputes between landlord and tenant, neighbors, family members, local businesses and their customers, hospitals and their patients, and governmental agencies and their clients, expect where prohibited by federal law.
B. A system of providing information concerning the resolution of disputes and the services available in the community.
C. An efficient and effective referral system which assists in the resolution of disputes and otherwise guides the client to the appropriate public or private agency to assist in the resolution of the particular dispute, including referrals to the justices of the peace, municipal courts, lawyer referral systems, legal aid services, district attorney, city attorneys, district courts, mental health services, other alternative methods of resolving disputes and other governmental and private services.  (Ord. 1448, 2015)

3.34.090 Neighborhood Justice Center rules and procedures
The Justice Court shall establish rules and procedures for the Neighborhood Justice Center that are closely modeled after the program established by the American Bar Association for multi-door courthouses for the resolution of disputes.  (Ord. 1448, 2015)

3.34.100 Child custody and visitation rules and procedures
The District Court shall establish by rule approved by the Supreme Court a program of mandatory mediation in cases which involve the custody or visitation of a child.  These rules must be promulgated pursuant to subsection 1 of Section 3.500 of the Nevada Revised Statutes and provide for the matters listed in subsection 2 of the same section of state statute.  (Ord. 1448, 2015; Ord. 735, 1996)
